Terms of use

The offer and sale of products on theokids.de are managed by these Terms of Use, together with the Return Policy and the Privacy Policy. Products purchased on theokids.de are sold directly by The O (“the Seller”), with head office in Germany, Sprottauerstr. 29, 90475, Nuremberg, VAT registration number DE364209447 .

These Terms of Use exclusively regulate the offer, transmission and acceptance of the ordered products on theokids.de , between the users of theokids.de and the Seller.

It is possible to request any information through the assistance services by contacting our Customer Care. It will also be possible to find information about orders and shipments, refunds and return of products purchased on theokids.de.

PAYMENTS

All digital payment procedures are carried out through a secure connection directly connected to the bank owner and operator of the online payment service; data is transmitted in encrypted form which guarantees the protection of data transmission.

The sales prices of the indicated products on theokids.de include VAT and any other tax that may be applicable in relation to the sale.

Product prices may be subject to updates.

Once the order is placed, no further changes can be done to the shipping informations.

The Customer can choose between the following payment methods:

1. PAYPAL;

2. BANK TRANSFER;

1. In case of payment through PAYPAL, you will be redirected to the www.paypal.com website to pay for the products according to the procedure provided for and regulated by PAYPAL, and to the terms and conditions of the contract agreed between the customer and PayPal itself.

The data entered on the PayPal site will be processed directly by it and will not be transmitted or shared with THE O. THE O will not be able to know and memorize in any way the data of the credit card connected to your PayPal account, or the data of any other payment means connected with this account. The total amount due will be charged by PayPal together with the conclusion of the online contract. In the event of termination of the purchase contract and in any other case of reimbursement, for any reason, the refund amount will be credited to your PayPal account. The time for the refund on the means of payment connected to this account depend exclusively on PayPal and the banking system. Once the refund authorization has been given to the specific account, THE O cannot be held responsible for delays or omissions in crediting the refund amount, any dispute will be opened directly with PayPal.

4. If you selected the BANK TRANSFER as payment method, once the order has been confirmed, you will have to make a bank transfer using the following details received also by e-mail with the order confirmation:

The payment proof is given by the credited amount to the Seller’s account.

You will be required to send a copy of the payment by e-mail at theokidswear@gmail.com within 72 hours from the order confirmation.

If within this period THE O will not receive a copy of the payment, the order will be cancelled.

We will ship the order when the bank transfer has reached our bank account and as soon as the goods are available in our warehouse.

SHIPPING

The O delivers all over the world by UPS and DHL .

To ensure an easy and pleasant shopping experience, for all EU countries, customs fees and duties are already included in the final price without any further charge (there may be excluded countries due to their national regulation and the impossibility to apply the service).

During sales or special promotions, processing times may be longer. We apologize for any inconvenience.

You can choose to have your order delivered to the address you wish.

If, however, for some reason the delivery is refused or the customer becomes untraceable, the package may risk being sent back to Germany at the Client’s expense including any import fees that may be assessed upon re-entry to Germany. These fees will be deducted from any eventual reimbursement.

THE O will do its best to ensure delivery within the scheduled time, but cannot be held responsible for any delays due to customs operations, verification, or causes of force majeure beyond its control.

Important: In the event that the shipment is not delivered twice but returns to the sender, THE O will no longer accept further orders.

Important Shippment Information


Please consider the following information:

– For security reasons, all purchases made on theo.de will require the signature of the Customer or of an adult on his behalf;

– We are unable to redirect orders to a different address after shipping. Therefore, please ensure you provide an address where you can be contacted at the time of delivery based on the scheduled delivery;

– The courier do not deliver to PO boxes or postal codes without a specified address;

If you are not available at the delivery moment, the courier, depending on the area, will proceed with one of the following solutions:

– will deposit a notice of passage near the bell or your mailbox, and will make a total of three delivery attempts in 3 consecutive working days;

– will deposit your order to an authorized collection center: also in this case the courier will leave a notice with the shipment details;

– once the term has expired, your order will be returned to us and the order will be treated as a rejected.

When do we deliver?

Deliveries are made from Monday to Friday during the opening hours of offices. It is not possible to book a delivery at specific times.

The courier do not deliver during the public holidays and also the day before.

Insurance

Please note that we will ensure every order, until it is delivered to you. We request a signature for each product delivered, and once is accepted, the goods are no longer insured. If you have not received your package (for example in case of a gift) then the person who signed confirms the delivery and is responsible for the package.

If for any reason the package appears tampered with or if the warranty seal is not intact, customers are asked to sign subject to checking/verification or to refuse delivery. If the delivery has been accepted with an unauthorized signature or there is evidence of tampering of the package, customers are asked to immediately report the incident to the courier and contact THE O at theokidswear@gmail.com. If the package is damaged, or if part of the goods is missing, the packaging must be kept for further investigation.

Follow your order

When the order is handled to the courier you will receive an e-mail containing the shipping number and the instructions to track the progresses. Delivery days may change depending on the type of shipment selected during the order.

It is also possible to check the status of your order in the My Orders section.

We advise you to check the status of your shipment frequently: in your absence, you may not immediately notice the transit notice or, for various reasons, the courier may not be able to locate the right address.

In case of delays due to customs offices, customers will be contacted directly by the courier or by THE O.

To ensure that the shipping costs are accurate, we recommend that you select the shipping country while you browse our site.

 

 

RETURNS AND REFUNDS

If an item do not satisfy you, is possible to return it for free within 14 days from the moment it was delivered to you.

The items must be returned intact and in the same conditions as they were received, provided with the tags indicating the bar code and any other seal that is part of the product.

If you are a registered customer, you can request a return directly from the My Orders page, in your THE O  account. Click on “Request a return”, indicating the item(s) you wish to return, the quantity and the reason. Then, select “Proceed”.

If you purchased as a guest, you can make the return request directly from the Orders&Returns Guest page. Click on “Request a return”, indicating the item(s) you wish to return, the quantity and the reason. Then, select “Proceed”.

The withdrawal period expires after 14 days from the moment the Customer or a third party other than the carrier and the designated customer acquires physical possession of the goods.

The cost of transport by courier indicated by THE O will be FREE. If the return is made using a different courier, all costs will be a the customer’s charge.

THE O reserves the right to decline returns sent by couriers other than those indicated in the email with return instructions if the delivery contains additional costs or requires collection from a collection point of the courier.

THE O also reserves the right to decline unauthorized returns or those that do not comply with all the conditions set forth.

IMPORTANT: If the order was delivered in a country outside the European Union, any customs fees and taxes that the courier may require, and THE O will have to anticipate, will not be reimbursed, but will be deducted from the credit or refund.

Remember: if you do not use the return label, THE O cannot be held responsible for any theft or loss.

General Information

The refund will be completed within 14 working days from the moment the return process starts at the warehouse and the notification by e-mail arrives. In case of canceled orders before shipment, the refund will be made within 3 working days from the acceptance of the request.

Please return the item in its original condition: if your return does not meet these conditions, we will not be able to proceed with the refund and the item will be returned to you. If you make a return for an item that has a defect, you will also be reimbursed for the shipping costs.

You can make a return and get a refund, for a damaged product or do not comply with the order, and for items that do not meet your needs, regardless of their quality (for example: wrong size).

Any existing credit must be used within a year for a purchase or sending the bank details so that THE O may proceed with the refund.

The garments must not have been worn, washed, altered or with any signs of use. The soles of the shoes must be in perfect condition and show no signs of any kind.

Each item must be returned with all labels and tags attached, and included of all original packaging and accessories (dust bags, hangers, garment covers etc.) received with the order.

All footwear and accessories must be returned along with their original box, which is considered to all means an integral part of the product itself and which must not have been in any way damaged and / or altered, nor used as a single external packaging.

Swimsuits (bikinis, briefs, etc.) must be tried on your own underwear. Returns will be declined and returned to the customer if the items show signs of use.

The products must be returned in the original packaging with the original accessories, components and illustrative materials. They must also be packaged appropriately, in the same way as they were received.

Returns must be sent inside the THE O box, which must be well sealed with adhesive tape. In the absence of our box, another package suitable for shipping items may be used.

In the event that the customer receives defective goods, or that an error occur in a shipment by THE O, the customer is invited to immediately contact theokidswear@gmail.com.

THE O reserves the right to request photographic evidence before authorizing returns for defective goods and incur the shipping costs for the return of the goods.

Returns authorized by THE O must be sent from the same country in which the original order was delivered.

THE O also reserves the right to reject unauthorized returns or those that do not comply with all the conditions set forth.

In these cases the goods will be returned to the sender at the original shipping address.

Any acceptance of these returns, however, will involve a charge equal to 10% of the value of the returned goods.

Where’s my return?

It is possible to trace the status of a return from the moment it is delivered to the courier. The tracking number is provided on the return label you used to return the package.

Is it possible to make a change?

Please be informed that the purchased products cannot be replaced and, therefore, if you wish to change an item, you can make a return according to the terms described in our Return Policy and then proceed with a new order.

Refund

After receiving your return, we will verify the integrity of the items before accepting them. This check can take about 3 to 5 working days after delivery.

The refund method will follow the one used for the purchase:

• PAYPAL PAYMENTS: the reimbursement will be visible in your Paypal account within 48 hours from the reimbursement confirmation e-mail;

• PAYMENT BY BANK TRANSFER: the refund will be made by payment or transfer to a bank or giro account indicated by you; the term required for reception depends on your Institute.

The refund will be issued in the same currency as the original purchase. Any differences in the amount due to exchange rate fluctuations cannot be reimbursed.

In case of free shipping, the refund amount will correspond to the returned products.

Exclusion

Are excluded from returns: stockings and tights.
